Common questions

Short answers about how I work. Questions on specific cases are answered on the practice pages.

About working with me

How does the first consultation work?

I listen, look at your documents and explain the possible routes, the risks and rough timelines. We can meet at the office, by phone or online.

How are fees set?

Fees depend on the complexity and scope of the case. The amount and payment terms are set out in a written contract before work begins.

Can you guarantee the outcome?

No advocate can guarantee a court’s decision, and the Bar’s rules of conduct forbid promising one. My commitment is to prepare the case carefully, be open about the risks and defend your position at every stage.

Will my information stay confidential?

Yes. Everything about your enquiry and your case is covered by advocate–client privilege and protected by law.

I am a foreigner. Can you help me?

Yes. I advise in English and Russian and help with registration, residence permits, buying property, and dealings with the police and courts.

European Court of Human Rights

When can I apply to the European Court?

Once all domestic remedies have been exhausted, usually up to the Supreme Court. The application must be lodged within four months of the final domestic decision.

In what language is the application written?

The initial application may be lodged in Azerbaijani. Once the case is communicated to the Government, correspondence is usually in one of the Court’s official languages, English or French.

Can the European Court overturn a national court’s decision?

No. The Court decides whether the Convention was violated and may award just satisfaction. A judgment finding a violation can be grounds for reopening the case in the national courts.

Divorce and child support

What documents do I need for a divorce?

Usually the statement of claim, the marriage certificate, the children’s birth certificates, copies of both ID cards and a receipt for the court fee. The exact list depends on your situation; we settle it at the first meeting.

My spouse does not agree to the divorce. What can I do?

Without consent, the marriage is dissolved by a court. The court may give the couple time to reconcile. In such cases it pays to prepare your position and evidence in advance.

How is child support calculated?

Child support is set either as a share of the parent’s income or as a fixed sum. If income or family circumstances change, the amount can be increased or reduced through the court.
