Questions about this

When can I apply to the European Court?

Once all domestic remedies have been exhausted, usually up to the Supreme Court. The application must be lodged within four months of the final domestic decision.

In what language is the application written?

The initial application may be lodged in Azerbaijani. Once the case is communicated to the Government, correspondence is usually in one of the Court’s official languages, English or French.

Can the European Court overturn a national court’s decision?

No. The Court decides whether the Convention was violated and may award just satisfaction. A judgment finding a violation can be grounds for reopening the case in the national courts.
